Agreement to these Terms

These Terms of Use govern your access to and use of theproductshortlist.com, including its articles, reviews, buying guides, forms, newsletters, and related content (collectively, the “Site”).

The Site is operated by Mynians, LLC under the name The Product Shortlist. In these Terms, “The Product Shortlist,” “Mynians, LLC,” “we,” “us,” and “our” refer to the Site’s owner and operator.

By accessing or using the Site, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Site.

About the Site

The Product Shortlist publishes product reviews, comparisons, recommendations, buying guides, and related consumer information. Our content may be based on hands-on testing where specifically stated, product research, manufacturer information, retailer information, user feedback, third-party testing, professional experience, and editorial judgment.

Our verdicts—including SHORTLISTED, WORTH IT, SITUATIONAL, and SKIP—represent our editorial opinion at the time the content is published or updated. Information about our review process is available on our How We Test page.

A verdict is not a guarantee, warranty, certification, or personalized professional recommendation. Your experience with a product may differ based on how, where, and why you use it.

Eligibility

The Site is intended for a general audience. You must be at least 13 years old to use the Site. If you are under the legal age of majority where you live, you may use the Site only with the permission and supervision of a parent or legal guardian.

Affiliate relationships

The Product Shortlist participates in affiliate marketing programs. If you click certain links and complete a purchase or other qualifying action, Mynians, LLC may receive a commission or referral payment. This does not normally increase the price you pay.

As an Amazon Associate we earn from qualifying purchases.

The Site may also participate in programs operated by Impact, CJ Affiliate, Awin, individual retailers, and other affiliate networks or service providers.

An affiliate relationship does not guarantee a positive review, a particular score, inclusion in a shortlist, or any other editorial outcome. Our reviews and verdicts are based on our editorial standards and judgment.

Content on the Site is provided for general informational and educational purposes only. It is not medical, legal, financial, tax, insurance, cybersecurity, engineering, or other professional advice.

Reviews involving sleep, fitness, wellness, safety, security, health, or financial products address general consumer considerations. They are not evaluations of clinical effectiveness, regulatory compliance, or suitability for your individual circumstances.

Consult a qualified professional before making a decision that could materially affect your health, safety, finances, legal rights, property, or business.

Product information, prices, and availability

Product prices, promotions, availability, specifications, warranties, shipping terms, return policies, and other details may change without notice. This information is controlled by manufacturers, retailers, and other third parties—not by Mynians, LLC.

We may display the date on which a price, offer, or product detail was checked. That date does not guarantee that the information will remain accurate when you visit a retailer’s website.

Always review the current product description, price, seller information, shipping charges, warranty, return policy, and availability on the retailer’s website before purchasing.

If information on the Site conflicts with information presented by the retailer at checkout, the retailer’s current information controls your transaction with that retailer.

Purchases from third parties

Unless explicitly stated otherwise, The Product Shortlist does not directly sell, ship, manufacture, warrant, repair, or accept returns for the products discussed on the Site.

Purchases made after following a link from the Site are transactions between you and the applicable retailer or seller. Those transactions are governed by the retailer’s prices, policies, terms, warranties, and customer-service procedures.

Questions about an order, payment, delivery, return, refund, warranty, product defect, or recall should be directed to the retailer, seller, manufacturer, payment provider, or other party responsible for the transaction.

Editorial content and opinions

Reviews, rankings, comparisons, scores, verdicts, and recommendations represent opinions—not statements of universal fact. A product that works well for one person, budget, environment, or use case may not work well for another.

We may revise, correct, update, remove, or change content when products, prices, evidence, availability, our testing results, or our editorial judgment changes.

We do not guarantee that every product in a category will be reviewed, tested, compared, or considered.

Intellectual property

Unless otherwise noted, the Site and its original content—including its text, graphics, layouts, photographs, videos, logos, icons, review formats, rating systems, selection criteria, databases, and other original materials—are owned by Mynians, LLC or used with permission.

This includes The Product Shortlist name, The Shortlist Method, “The Cut” data or presentation format, and the SHORTLISTED, WORTH IT, SITUATIONAL, and SKIP verdict system, to the extent protected by applicable intellectual-property law.

You may read, share, quote brief excerpts from, and link to publicly available Site content for lawful personal and non-commercial purposes, provided you give clear credit to The Product Shortlist and do not misrepresent the content.

Without our prior written permission, you may not:

  • Republish complete articles, reviews, buying guides, or substantial portions of our content
  • Copy, reproduce, sell, license, or commercially distribute our content
  • Systematically scrape, extract, download, or compile our reviews, scores, verdicts, pricing data, product selections, or databases
  • Use our content to create a competing website, database, review service, training dataset, or commercial product
  • Remove copyright, trademark, attribution, affiliate, or other ownership notices
  • Present our content, ratings, or verdicts as your own

Product names, manufacturer logos, retailer names, photographs, and trademarks referenced on the Site belong to their respective owners. Their appearance is generally for identification, commentary, comparison, review, or editorial purposes.

Unless explicitly stated, no manufacturer, retailer, or product brand sponsors, endorses, or is affiliated with The Product Shortlist or Mynians, LLC.

Acceptable use

You agree not to:

  • Use the Site for an unlawful, fraudulent, abusive, or deceptive purpose
  • Attempt to gain unauthorized access to the Site, its hosting environment, administrative systems, accounts, databases, or connected services
  • Introduce malware, malicious code, harmful files, or automated attacks
  • Disrupt or interfere with the Site’s operation, availability, security, or performance
  • Send excessive automated requests or use scraping tools that disregard our access controls, robots.txt instructions, or written restrictions
  • Collect personal information about other visitors without authorization
  • Impersonate another person or misrepresent your identity, affiliation, or authority
  • Submit false, misleading, defamatory, infringing, threatening, obscene, or unlawful material
  • Use the Site to send spam, unsolicited promotions, or deceptive product submissions
  • Attempt to bypass security, rate limits, access restrictions, or other technical controls

Ordinary search-engine indexing that follows our published technical instructions is not prohibited by this section.

User submissions

The Site may allow you to submit product suggestions, comments, feedback, messages, links, or other material.

You retain ownership of original content you submit. By submitting content for editorial consideration or public display, you grant Mynians, LLC a non-exclusive, worldwide, royalty-free license to store, review, reproduce, edit, format, publish, display, and use that content in connection with operating, promoting, and improving the Site.

This license does not permit us to publicly disclose your private contact information simply because you submitted a private contact form or email.

You represent that:

  • You have the right to submit the content
  • The content does not violate another person’s copyright, trademark, privacy, publicity, contractual, or other legal rights
  • The content is not knowingly false, deceptive, defamatory, threatening, or unlawful
  • You have disclosed any material relationship you have with a product, seller, manufacturer, agency, or brand mentioned in the submission

We are not required to test, review, publish, retain, or respond to any submission. We may reject, remove, edit, or delete a submission at our discretion, subject to applicable law.

The Site contains links to retailers, manufacturers, affiliate networks, social-media platforms, video services, reference sources, and other third-party websites or services.

We do not control these third parties and are not responsible for their content, prices, availability, security, accessibility, privacy practices, terms, products, services, or business practices.

A link does not mean that Mynians, LLC approves or endorses every statement, product, service, or practice associated with that third party.

You access and use third-party websites at your own risk and should review their applicable policies before providing information or completing a transaction.

If you believe content on the Site infringes your copyright or other intellectual-property rights, send a written notice to hello@theproductshortlist.com.

Your notice should identify the protected work, identify the allegedly infringing material, provide its location on the Site, include your contact information, and explain the basis for your claim. We may request additional information before taking action.

Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT, REVIEWS, VERDICTS, LINKS, TOOLS, AND INFORMATION PROVIDED THROUGH IT ARE OFFERED “AS IS” AND “AS AVAILABLE.”

MYNIANS, LLC DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SITE WILL ALWAYS BE AVAILABLE, SECURE, OR ERROR-FREE
  • ALL CONTENT WILL BE COMPLETE, CURRENT, OR ACCURATE
  • A PRODUCT WILL PERFORM AS DESCRIBED OR MEET YOUR EXPECTATIONS
  • PRODUCT PRICES, OFFERS, SPECIFICATIONS, OR AVAILABILITY WILL REMAIN UNCHANGED
  • DEFECTS OR ERRORS WILL ALWAYS BE CORRECTED
  • THE SITE OR ITS SERVERS WILL BE FREE FROM HARMFUL COMPONENTS

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS. IN THOSE JURISDICTIONS, THESE EXCLUSIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MYNIANS, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AUTHORS, EDITORS, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR CONNECTED WITH:

  • YOUR ACCESS TO OR USE OF THE SITE
  • YOUR INABILITY TO ACCESS OR USE THE SITE
  • YOUR RELIANCE ON A REVIEW, VERDICT, COMPARISON, PRICE, OR OTHER CONTENT
  • A PRODUCT OR SERVICE PURCHASED FROM A THIRD PARTY
  • THE CONDUCT, CONTENT, OR PRACTICES OF A RETAILER, SELLER, MANUFACTURER, OR OTHER THIRD PARTY
  • LOSS OF DATA, REVENUE, PROFITS, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF MYNIANS, LLC FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID DIRECTLY TO MYNIANS, LLC FOR USE OF THE SITE DURING THE SIX MONTHS BEFORE THE CLAIM AROSE; OR
  • ONE HUNDRED U.S. DOLLARS ($100)

Because access to the Site is generally free, the applicable limit will normally be $100.

These limitations do not exclude liability that cannot legally be excluded or limited under applicable law.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mynians, LLC and its owners, officers, employees, authors, editors, contractors, and agents from claims, liabilities, damages, judgments, losses, costs, and reasonable legal fees arising from:

  • Your unlawful or unauthorized use of the Site
  • Your violation of these Terms
  • Content you submit through the Site
  • Your violation of another person’s rights
  • Fraudulent, abusive, or malicious conduct connected with your use of the Site

This section does not require you to indemnify Mynians, LLC for conduct for which indemnification is prohibited by law.

Privacy

Our collection and handling of personal information is described in our Privacy Policy. By using the Site, you acknowledge that you have had an opportunity to review that policy.

Governing law and disputes

These Terms and any dispute arising from or relating to the Site are governed by the laws of the State of Florida, without regard to conflict-of-law rules.

To the extent a dispute may lawfully be restricted to a particular forum, you agree that it will be brought in a state or federal court with jurisdiction in Orange County, Florida. You consent to the personal jurisdiction of those courts.

Nothing in this section prevents either party from bringing a qualifying matter in small-claims court or seeking temporary or emergency relief where permitted by law.

Changes to these Terms

We may update these Terms when the Site, our business practices, or applicable requirements change. The “Last updated” date at the top of this page identifies the most recent revision.

Updated Terms become effective when posted unless a later effective date is stated. Your continued use of the Site after the effective date constitutes acceptance of the updated Terms to the extent permitted by law.

Suspension and termination

We may block, restrict, suspend, or terminate access to all or part of the Site when we reasonably believe it is necessary to:

  • Enforce these Terms
  • Protect the Site or other visitors
  • Prevent fraud, abuse, unauthorized access, or security threats
  • Comply with a legal requirement
  • Discontinue or change a Site feature or service

Sections that should reasonably continue after termination—including intellectual property, disclaimers, liability limitations, indemnification, and dispute provisions—will remain in effect.

Severability

If any part of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will remain in effect.

No waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later. A waiver is effective only if it is made in writing by an authorized representative of Mynians, LLC.

Entire agreement

These Terms, together with the Privacy Policy and any other policies expressly incorporated into them, form the entire agreement between you and Mynians, LLC regarding your use of the Site.
